2 1. About the scope of land acquisition 1) Whether the land can be acquisitioned for the public interests prescribed by the law? If yes, how to define the public interests? And what are the enumerative definitions of the public interests in the corresponding law? 2) Whether the scope of land acquisition had been adjusted in accordance with the social- economic development?

3 1. Om formålet med arealerhvervelse 1)Skal arealerhvervelse til offentlige formål være foreskrevet i Hvis ja, hvordan man definerer de offentlige interesser? Og hvad er udtømmende definitioner af de offentlige interesser i den tilsvarende lovgivning 2)2) Er formålet med arealovertagelse blevet blevet justeret i overensstemmelse med den socio-økonomiske udvikling.

4 2. About the legal procedure of land acquisition 3 ） Which department/section will be the one to initiate the procedure of land acquisition? And how many steps do the entire procedure of land acquisition need? 4 ） In which step will the land owner be notified that his land will be acquisitioned? What is the mode of the notification? What are the contents of the notification to the land owner? 5 ） Which organization has the right to approve the land acquisition? With regard to the different land use types or different land sizes, are there any differences among the different organizations at different levels that have the approval rights? 6 ） During the land acquisition process, what contents will be examined by the organization that has the approval right? 7 ） What is the restriction for the time limit of land acquisition approval? Normally, how long does it takes from the beginning of land acquisition to the land user obtaining the land? 8 ） Whether does it need for approval about the land reserved temporally for the purpose of rushing to deal with an emergency and rescuing the disaster? Which department will be in charge of it?

5 2. Om den retlige proces for erhvervelse af jord 3) Hvilken myndighed skal indlede proceduren for arealerhvervelse? Og hvor mange trin indeholder proceduren for erhvervelse af jord? 4) I hvilket trin bliver vil grundejeren blive underrettet om, at hans land skal erhverves? Hvordan formidles den nye retstilstand? Hvad er indholdet af meddelsen til grundejeren? 5) Hvilken myndighed har ret til at gennemføre arealerhvervelser? I henseende til de forskellige formål, typer eller forskellige jordstørrelser, er der så nogen forskelle mellem de forskellige organisationer på forskellige niveauer, der har ret til at genemføre/godkende retten til arealerhvervelse? 6) Når arealerhvervelsen gennemføres, hvilke forhold vil blive undersøgt af den organisation, der har godkendelsen ret? 7) Hvad er tidsrammerne for gennemførelse af arealerhvervelse? Normalt, hvor lang tid tager det tager fra begyndelsen af jordkøb/arealerhvervelse til at de nye jordejere opnår rettigheder til arealer? 8) Hvis arealerhvervelse sker for at få arealet reserveret midlertidig for at undgå en katastrofe eller håndtere en nødssituation, hvilken myndighed kan så gennemføre denne arealerhvervelse.

6 3. About the compensation of land acquisition 9 ） Does land acquisition compensated according to the original land use purpose or the newly land use purpose? Whether has the calculation standard been stipulated by the corresponding Law? 10 ） Whether the monetary compensation is the only form for land acquisition? Does Denmark have other forms for the compensation? 11 ） With regard to the land acquisition compensation, does the bargaining/negotiation been done between the governmental organization with land owner or between the land user with the land owner directly?

7 3. Om kompensation ved arealafståelse 9) Fastlægges erstatningens størrelse ved arealafståelse i henhold til den oprindelige arealanvendelse formål eller det nye ? Hvorvidt følger beregningen et niveau/standard fastsat af den tilsvarende lov? 10) Er økonomisk kompensation den eneste form for erstatning ved arealafståelse? Har Danmark har andre former for kompensation? 11) Med hensyn til forhandlinger om kompensation, er disse så blevet foretaget mellem den mellem den statslige organisation og grundejeren eller mellem brugeren (land user) og ejeren direkte?

About the settlement of land acquisition conflict or dispute 12 ） When the dispute happens whether the land acquisition can be implemented or not, which departments or authorities should be raised the application by both parties for settling the disputes or hearing of witnesses? Or go to the court directly? What is the general procedure? 13 ） When the dispute happens related to the compensation, how to solve the problems? What is the settlement procedure’s difference between the compensation disputes with the land acquisition scale’s disputes? 14 ） Before the settlement of compensation dispute, whether the land user can decide to implement using the land based on the land acquisition decision?

9 4. Om konflikt eller tvist ved arealafståelse 12) Ved tvist om hvorvidt arealafståelse kan gennemføres, hvilke afdelinger eller myndigheder kan aktiveres for at løse tvister afhøring af vidner? Eller går man til retten direkte? Hvad er den generelle procedure? 13) Hvis tvisten er i forbindelse med erstatningens størrelse, hvordan kan man løse problemerne? Er der forskellig forligsprocedure ved tvister om henholdsvis arealafståelsen og om erstatningens størrelse. 14) Hvis der er uenighed om erstatningens størrelse kan arealafståelse så gennemføres alligevel og anvendelse i forbindelse med det nye formål påbegyndes?
